General Standard Terms and Conditions – Sprachschule Aktiv Augsburg

1. General Provisions:

1. By registering for a course, a contract between the customer and the Language School Sprachschule Aktiv Augsburg is concluded. Registration can be made online or by mail.
2. By registering for a course, the candidate commits himself/herself to pay in full the course fees before the beginning of the course or to pay by installments. When paying by installments, the first installment is due before the beginning of the course. Payments can be made by bank transfer, in cash at our office during business hours, or via PayPal.
3. The booking of a course requires a binding registration and payment. Only once full payment/payment of the first rate is made, the language school ‘Sprachschule Aktiv Augsburg’ is required to carry out the course.
4. Each class hour lasts 45 minutes. Applications, cancellations and alterations have to be in writing – preferably by email. Our teachers are not authorized to accept applications, cancellations and alterations in any form.
5. Sprachschule Aktiv Augsburg reserves the right to book premises depending on the requirements of the course and availability.
6. Sprachschule Aktiv Augsburg commits to have mainly native speakers run the courses. Students have no claim to a course taught by a specific teacher.
7. Sprachschule Aktiv Augsburg is dedicated to designing teaching material in a most satisfying matter, so as to fulfill the course participant’s requirements. However, Sprachschule Aktiv München assumes no responsibility for not attaining a specific language level or failing exams.
8. All prices are shown without German sales tax. Value added tax incurred abroad must be carried by the customer.

2. Cancellations and Refunds of Fees

1. This contract can be cancelled free of charge no later than 14 days (without giving any reasons) after conclusion of the contract. For this, cancellations must be submitted in writing (by post or e-mail).
Consequences of withdrawal:
If the Sprachschule Aktiv Augsburg has already provided services until withdrawal, you must pay a corresponding compensation, which reflects the costs of the already provided services.
2. At the time of booking a course, a fixed period of time and/or numbers of hours are decided upon. If the course participant fails to attend or interrupts a scheduled date, he or she has no right to claim reimbursement in form of money or substitute lessons. The right of withdrawal is not affected by this.
3. The student is authorized to cancel the booked course after the first lesson if the lesson falls short of his or her expectations. This request needs to be submitted in writing no later than 24 hours after the first lesson. In this case, the costs of the course will be refunded. Afterwards there will be no right for a refund of course fees.
4. In exceptional cases, Sprachschule Aktiv Augsburg reserves the right to switch teachers. In such case the student is not authorized to cancel his or her course.
5. The mere absence in a course does not equal to a cancellation, thus the student’s obligation to pay his or her course fee remains.

3. Cancellation, Reimbursement und Course Fees

1. In case a course has been booked online, the contract can be cancelled free of charge no later than 14 days after conclusion of the contract. For this, cancellations must be submitted in writing (by post or e-mail). If the course is not cancelled within that time frame and in a written form, the participant has to pay the course fees.
2. All language courses have to be paid 2 days before the start of the course. If the booked course has not been cancelled within the legal time frame of 14 days and in a written form, the participant has no right to claim reimbursement.
3. Booked private and company courses have to be taken within one year from invoicing. Any claim regarding re-scheduling lessons and/or (partial) reimbursement shall expire after one year.
4. In exceptional cases, Sprachschule Aktiv Augsburg reserves the right to switch teachers. In such case the student is not authorized to cancel his or her course.
5. The mere absence in a course does not equal to a cancellation, thus the student’s obligation to pay his or her course fee remains.

4. Specific Provisions for Private Courses, Couple Courses, and Company Courses

1. A student participating at a private, couple or company course has the opportunity to book lessons at Sprachschule Aktiv München according to his or her wishes. The student also may agree on suitable teaching dates with the teacher directly.
2. Each couple course contains 24 class hours.
3. A student participating at a private or company course may decide personally how many class hours he or she would like to book. Booking a specified number of class hours is binding. If the student does not plan to attend the course, which he or she has already booked and paid for, he or she has no right to claim reimbursement (neither full nor partially).
4. If a booked and agreed upon appointment cannot be realized, it has to be cancelled 24 hours prior to the appointment. In such case, the course date will be re-scheduled. If cancellation does not take place in time, the student has no right to re-schedule any missed lesson. If the last day of the deadline falls on a Sunday or holiday, cancellation has to take place on the last business day prior to that date.
5. Booked class hours have to be taken within one year from invoicing. Any claim regarding re-scheduling lessons and/or reimbursement shall expire after one year.
6. After consultation with Sprachschule Aktiv München, class hours previously paid for can be transferred to a third party. The student has to submit a written explanatory statement.

5. Specific Provisions for Intensive Courses, Semi-Intensive Courses, and Group Courses

1. Each group course contains 24 class hours which are being taught regularly on 12 pre-defined dates.
2. Semi-intensive courses will be arranged for German courses exclusively. Each semi-intensive course contains 40 class hours of 45 minutes. The starting date of the courses is set. The course will take place from Monday to Friday, except when there are only 3 students. In that case, course duration will be shortened, and the course will take place from Monday to Thursday.
3. Each intensive course contains 20 class hours every week with 4 class hours (each of them 45 minutes) daily.
4. The starting date of all courses is set. In exceptional cases, Sprachschule Aktiv München reserves the right to switch or change course dates. Course participants will be informed in a timely manner should any change occur
5. In case that the minimum number of participants would not be reached, Sprachschule Aktiv Augsburg reserves the right to either change or cancel the course. In case a student disagrees with the cancellation, his or her prepaid course fees will be reimbursed.
6. After consulting with Sprachschule Aktiv Augsburg, rebooking in form of changing the course can be approved in exceptional cases. The wish to transfer has to be submitted in writing no later than 2 business days before the beginning of the course. In case of the student failing to submit a written request or submitting it after the deadline, Sprachschule Aktiv München reserves the right to reject the request.
7. Upon completion of a course each course participants may attend a follow-up course. Each follow-up course requires new registration. Without new registration a place will not automatically be reserved.

6. Specific Provisions for insufficient Number of Participants and specific Provisions for German Courses

1. In case the minimum number of participants would not be reached regarding intensive, semi-intensive, and group courses, the course designated will take place. While hours will be shortened, payment terms remain the same.
2. Intensive courses containing 2 participants will be taught 2 class hours of 60 minutes each class hour. Intensive courses containing 4 participants will be taught 4 class hours of 45 minutes each class hour.
3. Semi-intensive courses containing 4 participants will be taught 2 class hours of 45 minutes each class hour. In case the number of participants is less than 4, point 5.2 applies
4. Group courses containing 2 participants will be taught 16 class hours of 45 minutes each class hour. Group courses containing 3 participants will be taught 20 class hours of 45 minutes each class hour. Group courses containing 4 participants will be taught 24 class hours of 45 minutes each class hour.

7. Specific Provisions for German Visa Courses

1. Sprachschule Aktiv Augsburg helps course participants acquire a visa (German Language Course Visa) for the period of the booked course at Sprachschule Aktiv Augsburg. In order to claim this, the student must register for a German course and pay the course fees.
2. In case of a visa for a German course being refused, the student commits himself/herself to send the German Consulate’s notice of rejection back to Sprachschule Aktiv Augsburg at its earliest. Based on that, course fees will be reimbursed. Sprachschule Aktiv Augsburg reserves the right to retain EUR 100.00 for the extra administration expenses.
3. Course participants who were granted a visa due to our certificate for issuing a visa, cannot cancel an already booked course.
4. Should the participant not have heard back from the embassy a week before the start of the course, it is possible for him/her to transfer the registration to the follow-up course which will take place four weeks later. In that case, he/she would have to inform Sprachschule Aktiv Augsburg in writing (preferable via email) regarding a transfer request. If this does not happen, the costs will not be reimbursed. Subsequently, the participant (due to the lack of information from the German Consulate) may neither postpone nor rebook the course. A transfer can only be requested once.

8. Trial Lessons and Public Holidays

1. The participant has the right to participate in a trial lesson organized by Sprachschule Aktiv München that is free of charge and non-binding.
2. In case of the course participant’s subsequent registering for the course, the trial lesson will be counted as a regular class hour.
3. Regarding group, intensive, and semi-intensive courses as well as private, couple, and company courses, a trial lesson lasts a period of a class hour (45 minutes).
4. In case of a participant registering for a free of charge trial lesson without attending the scheduled course date he or she will be charged EUR 42.00.
5. Cancelling a trial lesson must be submitted in writing no later than 24 hours before the scheduled course date. Otherwise, the participant has to pay the class hour.
6. On public holidays in Germany, there will be no group courses. The cancelled group course will not be rescheduled.

9. Language Study Travel

1. Sprachschule Aktiv Augsburg assumes no responsibility for mediated language trips. Sprachschule Aktiv Augsburg’s field of activity is limited to the mediation of language courses as well as consultation.

10. Mediation of Accommodation

Sprachschule Aktiv Augsburg offers help finding accommodation to all course participants who book a German course for at least four weeks and require assistance. Sprachschule Aktiv acts solely as an intermediary and bears no responsibility for the validity or integrity of the offer in relation to the arranged accommodation as well as for any dispute with the respective landlord. Sprachschule Aktiv Augsburg accepts no liability for accidents, theft or other damage to items (or property). The contract for the respective accommodation is concluded directly between the course participants and the landlords.

11. Vouchers

Vouchers are not changeable in cash. However, they can be used for booked services. All gift vouchers will expire after 12 months from the date of issue.

12. Disclaimer

1. Sprachschule Aktiv Augsburg does not accept responsibility for damage, injuries or casualties of the participant. Similarly, Sprachschule Aktiv Augsburg does not accept responsibility for property damage that occurs during class hours or on the way to the language school.
2. Sprachschule Aktiv Augsburg does not accept responsibility for any damages resulting from knowledge transfer.
